Major AI companies are attempting to develop artificial superintelligence (ASI). These AI systems would be able to fully replace and outmatch human individuals and organizations across every domain, including domains like intelligence, cyber operations, R&D and military strategy.
While these systems could operate fully autonomously, AI companies admit that there is no known way to keep them under control, should they be developed.
There is no question that ASI has the potential to undermine the national security of the United States. In fact, leading AI experts have gone as far as warning that these systems pose a risk of human extinction.
This discussion draft proposes a framework to decisively eliminate these threats to the national security of the United States, by criminalizing the development of ASI domestically and extraterritorially, and regulating the precursors that could be used to build it.
This is the first legal text that tackles the problem of ASI head on, defining a framework to target its security risks while aiming to preserve American leadership in beneficial AI.
